These Terms of Service (the "Terms") are a binding agreement between you and FOREPAID, LLC ("FOREPAID," "we," "us," "our") governing your use of the FOREPAID iOS app, the website at forepaid.app, and any related services (collectively, the "Service"). By creating an account, installing the app, or otherwise using the Service, you accept and agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 18 years old to use the Service. If you are using FOREPAID to record wagers with other people, you confirm that such wagering is legal in your jurisdiction and that you are of legal age to wager there. Some US states restrict or prohibit any form of social wagering — it is your responsibility to know and follow the law where you are. We may, at our discretion, restrict or refuse the Service in jurisdictions where wagering activity is prohibited.
FOREPAID is a recordkeeping, scorekeeping, and dispute-resolution tool for recreational golfers who already wager among themselves on the first tee. We help you:

FOREPAID is sold as an auto-renewing subscription through the Apple App Store. Current pricing: $9.99 per month (Monthly), $59.99 per year (Standard Annual), or $39.99 first year (Founder Annual — an introductory rate capped at the first 500 paying subscribers; after year one, your subscription renews at the Standard Annual rate). Billing, refunds, and cancellation are handled by Apple under their standard App Store policies; manage your subscription in iOS Settings → Apple ID → Subscriptions. We do not see your payment-card data and we cannot directly issue refunds — refund requests must go through Apple.
Every new FOREPAID player gets their first round end-to-end on the house — no plan, no payment method required — before the paywall appears. Refer-a-Friend: when a friend signs up with your referral code and completes their first paid month, both of you receive one extra month added to your subscription via an Apple App Store promotional offer.
If you cancel before a renewal date, you keep access through the end of the current term and are not charged again. We do not pro-rate refunds for partial periods.

FOREPAID's wager engine produces results that you and your foursome have agreed in advance to abide by, but the actual obligation to pay (and the legality of doing so) rests entirely between the players. FOREPAID:
If you live in a jurisdiction where wagering on golf is prohibited, do not use the wagering features. The scorecard and Russ narration features remain available without any wager being placed.
The "Russ Golfcaster" voice is generated by an AI text-to-speech service. The personality, tone, and humor are designed to feel like a locker-room broadcast partner, with several trash-talk intensity levels (Friendly, Spicy, Nuclear, and an opt-in Uncensored). Russ's calls are based on the data you and your foursome enter into the app — bad data in, bad call out. We do not warrant that Russ's narration will always be in good taste, free from error, or aligned with everyone in your group's preferences. If a player in your group prefers not to hear Russ, they can mute him at any time from within their round view.
Uncensored Mode. The Uncensored trash-talk level (Level 4) contains adult language and is disabled by default. Only the round host can enable it, and only after confirming they are 18 or older and that everyone in the round consents to adult content. When the host enables Uncensored Mode for a round, all players in that round will hear the same level of language. If you do not want to hear adult language, mute Russ for the round (per the previous paragraph) or ask your host to lower the trash-talk level.
Host audio control. The round host can also configure where Russ audio plays in the foursome — which players' phones audibly speak Russ, and which stay silent. The host sets this at round setup and can adjust it mid-round from their menu. This is intentional for shared-audio scenarios (e.g., one phone is connected to a Bluetooth speaker in the cart and drives audio for the group). Your personal Russ-mute toggle on your own phone always overrides the host's policy for your phone, so you can silence Russ on your phone at any time even if the host hasn't included your phone in the audio set.
We own the FOREPAID name, logos, app design, code, brand assets, and any related materials. You may not copy or reuse them outside ordinary use of the Service. You retain ownership of your own data (your name, scores, payment handles, the content of the rounds you play). By using FOREPAID you grant us a limited license to use your data solely to provide the Service to you and your foursome.
You can terminate your account at any time from the Profile screen. We can suspend or terminate your access if we reasonably believe you have violated these Terms, our Privacy Policy, or applicable law. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, dispute resolution) will continue to apply after your account is closed.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, FOREPAID DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT WARRANT THAT THE WAGER-ENGINE OUTPUT IS CORRECT IN EVERY EDGE CASE — IT IS YOUR RESPONSIBILITY TO REVIEW SETTLEMENT RESULTS BEFORE TRANSFERRING MONEY.
TO THE FULLEST EXTENT PERMITTED BY LAW, FOREPAID AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) FIFTY US DOLLARS. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, IN WHICH CASE THEY APPLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.
You agree to indemnify and hold FOREPAID, LLC and its officers, members, employees, and contractors harmless from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of (a) your use of the Service in violation of these Terms or any applicable law, (b) your interactions with other users, including wagers and settlements, or (c) your violation of any third party's rights.
These Terms are governed by the laws of the State of Minnesota, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to the Service or these Terms will be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures, in Hennepin County, Minnesota, before a single arbitrator. The arbitrator's decision will be final and may be enforced in any court of competent jurisdiction. You and FOREPAID each waive the right to a jury trial and the right to participate in a class action against the other.
The above arbitration clause does not apply to (a) actions to enforce intellectual property rights, (b) small-claims-court matters (each party may bring small-claims actions in lieu of arbitration), or (c) injunctive relief sought to halt ongoing harm.
If you obtain FOREPAID from the Apple App Store, you also agree to Apple's standard end-user license agreement for App Store apps (the "Apple EULA"). In the event of any conflict between the Apple EULA and these Terms, the Apple EULA controls only with respect to subjects it explicitly covers (refunds, billing, app review).
We may update these Terms as the Service evolves. When we do, we will revise the "Last updated" date at the top and, for material changes, notify you in the app before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
